    Chief Commissioner for Persons with Disabilities

    Office of the Chief Commissioner for Persons with Disabilities (Divyangjan)

    1. The Office of the Chief Commissioner for Persons with Disabilities was set up under Section 57(1) of the erstwhile Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and continues to function under Section 74 of the Rights of Persons with Disabilities Act, 2016. The Chief Commissioner for Persons with Disabilities has been assigned certain powers of a Civil Court for effective discharge of its functions.
    2. The Chief Commissioner may also, on his own motion, or on the application of any aggrieved persons or otherwise looks into complaints relating to deprivation of rights of persons with disabilities or non-implementation of rules, bye-laws, regulations, executive orders, guidelines, or instruction, etc., made or issued for the welfare and protection of rights of persons with disabilities and take up the matter with the concerned authorities. The Chief Commissioner is mandated to monitor utilization of funds disbursed by the Central Government for the benefit of persons with disabilities and take steps to safeguard the rights and facilities made available to the persons with disabilities under the Rights of Persons with Disabilities Act, 2016 or any other law for the time being in force.
    3. The office of the Chief Commissioner is an accessible and expeditious site of dispute resolution for divyangjan. Most proceedings before the Chief Commissioner relates to reservation/relaxation in employment, service matters (Promotion, transfer, harassment, etc), education (reservation/relaxation in admission, facilities/infrastructure and scholarship, etc), conduct of examination (scribe/extra-time/relaxation), disability certificate, accessibility and benefit of schemes, etc.  Recommendations/Advisories are issued to establishments to ensure that divyangjans are not discriminated against.
